Judicial updates:
- Torres v. United States is a case from the 9th Circuit that is pending before the Supreme Court. The question presented in the case is whether an individual may bring an as-applied Second Amendment challenge to 18 U.S.C. 922(g)(1) which prohibits individuals convicted of felony offenses from purchasing or possessing firearms. An as-applied challenge is one that alleges that the prohibition is unconstitutional as-applied to the particular person rather than a challenge that the prohibition is unconstitutional in all circumstances. The underlying criminal convictions in the case are aggravated DUI with a person under 15 in the vehicle and aggravated driving or actual physical control of a vehicle while under the influence of intoxicating liquor or drugs. - In Folajtar v. Barr, the 3rd Circuit upheld the felony firearm prohibitor in a divided decision as discussed in the Duke Center for Firearms Law blog and in the New York Times’ piece on how Justice Barrett’s Vote Could Tilt the Supreme Court on Gun Rights.
